What the EU Responsible Person actually does.

The Responsible Person is the EU-established legal entity required for every consumer product sold into the EU under Regulation (EU) 2023/988. Their name, address and contact must appear on the product or its packaging.

Their statutory duties under Article 4 include: verifying technical documentation exists, keeping the EU Declaration of Conformity on file, cooperating with market surveillance authorities, and informing authorities of non-conformity within 24 hours of discovery.

From scope to surveillance, in four steps.

Scope audit

We inventory your EU-bound SKUs, categorise them under harmonised standards (EN, ETSI, EU directives), and identify gaps in technical documentation.

RP appointment

CiDATax is formally appointed as your EU Responsible Person under Art. 4. Our name, Milano address and contact appear on your product or packaging.

Risk assessment

Technical documentation review, EU Declaration of Conformity drafting, retention of files for 10 years under Art. 9. Updated when products change.

Ongoing surveillance

We monitor Safety Gate notifications, respond to market surveillance correspondence, manage 24-hour reporting, and update your listings on Amazon and other marketplaces.

Marketplace consequence
Automatic delisting

Amazon, eBay, Cdiscount and others auto-delist products lacking a valid EU Responsible Person. Detection takes hours, reversal takes weeks.

Customs consequence
Import detention

Member-state customs can detain shipments where Responsible Person details are absent or unverifiable. Storage costs and demurrage accrue daily.

Penalty consequence
Fines & recalls

National sanctions vary by member state, but reputational damage from a forced recall lasts longer than any fine.
